What is Title IX?

Title IX of the Education Amendments Act of 1972 ("Title IX") is a federal law intended to ensure sex and gender equality and protect students against sexual harassment in all school programs and activities, including extracurricular, athletic and other programs, that occur at school, on the school bus, or off campus during school-sponsored events.  

The East Troy Community School District is committed to providing an environment where every student feels supported, welcomed and respected and as such shall not discriminate against any person on the basis of sex in any of its curricular, career and technical education, co-curricular, student services, recreational or other programs or activities, or in admission or access to any programs or activities offered by the District.   It is the District’s policy to protect all students, regardless of sexual orientation or gender identity.

How do I report an incident of sexual harassment?

Any student (or the parent/guardian of a student) who believes he/she has been subjected to sexual harassment or sexual violence by another student, District employee or other person should immediately report the incident. The complainant may report the alleged sexual harassment or sexual violence to any principal, teacher, counselor, social worker or other District employee who shall be responsible for forwarding the complaint to the District’s Title IX Coordinator for review and action as necessary.  Complaints can be made orally or in writing.

Filing Formal Complaints of Title IX Sexual Harassment

As required by the federal Title IX regulations, the District has established a formal grievance process for investigating and resolving “formal complaints” of “sexual harassment,” as those terms are defined in the regulations.

An individual who is alleged to be the victim of conduct that could constitute sexual harassment under the federal Title IX regulations (i.e., a Title IX “complainant”), or a parent or guardian who has a legal right to act on behalf of such an individual, may file a formal complaint of sexual harassment.  No Title IX complainant is obligated to file a formal complaint, but a qualifying formal complaint is necessary for the District to start an investigation using the District’s formal Title IX grievance process. 

Complainants are expected to file formal complaints of sexual harassment with the District Title IX Coordinator by submitting a document or electronic submission in person, by U.S. mail to Kate Harder, 2040 Beulah Ave, East Troy, WI 53120, or by electronic mail to harkat@easttroy.k12.wi.us.

Complaint Process

All complaints of sexual harassment or sexual violence against District students shall be investigated in a timely manner.   Investigations will be adequate, reliable and impartial,  allowing the opportunity for both the alleged target(s) and the alleged perpetrator(s) to identify witnesses and evidence.  The District’s investigation will be separate from any corresponding investigation by any law enforcement or child protection agency.

Where necessary, the District will take immediate steps to protect the alleged target pending the final outcome of the investigation. Such interim measures may include, but are not limited to, ensuring the alleged target continues to have equal access to the District’s education programs and activities, protection from the alleged perpetrator and from any retaliation, academic accommodations and altered schedules or activities.

Title IX Nondiscrimination Policy Statement

The East Troy Community School District is committed to equal educational opportunity for all students in the district.

It is the policy of the East Troy Community School District, pursuant to s. 118.13, Wis. Statutes and PI 9, that no person, on the basis of sex, race, national origin, ancestry, creed, religion, pregnancy, marital or parental status, sexual orientation or physical, mental, emotional, or learning disability, may be denied admission to any school in this district or be denied participation in, be denied the benefits of, or be discriminated against in any curricular, extracurricular, pupil services, recreational, or other program or activity.

This policy also prohibits discrimination under related federal statutes, including Title VI of the Civil Rights Act of l964 (race and national origin), Title IX of the Education Amendments of l972 (sex), and Section 504 of the Rehabilitation Act of l973 (disability).

It shall be the responsibility of the District Administrator to examine existing policies and develop new policies where needed to ensure that the East Troy Community School District does not discriminate pursuant to federal and state law. The District Administrator shall ensure that an employee is designated annually to receive complaints filed under s. 118.13, Wis. Statutes. PI 9, Wis. Admin. Code, Title IX of the Education Amendments, and Section 504 of the Rehabilitation Act of l973. To resolve complaints alleging violation of these laws, and assure compliance with s. 118.13, Wis.
